This presentation will explore some common problems that arise during the deposition of the trucking company’s representative. In particular, it will cover how the new “reptile” theory of damages is being used by Plaintiff’s attorneys to attack the company both at the deposition stage and at trial. The reptile damage theory has revolutionized litigation in trucking cases and has led to an astonishing number of huge verdicts. Many of these cases were originally defensible, but became indefensible due to mistakes made during the deposition of the company representative. This presentation will explain how the plaintiff’s bar is using the reptile damage strategy, the most common avenues of attack, and what can be done to defend against these techniques.
